Temporary Partial Disability
If you are unable to work full-time, you may be eligible for temporary partial disability workers’ comp benefits. It takes five days off work in a twenty-day period to qualify for temporary disability. Benefits end when you are determined by a physician that you can work, your injury or illness is stable and your employer has offered you light duty.
Permanent Partial Disability
Permanent partial disability benefits are available through workers’ compensation when an injured worker suffers a permanent impairment due to a work-related injury. It is based on the disability percentage, wage and the employee’s age. A physician or chiropractor must attest that you are medically stable and have reached maximum improvement in your condition. This benefit is normally paid in a lump sum.
Temporary Total Disability
Temporary total disability benefits are awarded under workers’ compensation to those who cannot perform the job duties they had before on a short-term basis. The medical provider must attest you could not work for five days following your injury or five days within a 20-day period running consecutively. In addition, your employer did not offer light-duty tasks within that period.
Permanent Total Disability
An injured worker can be awarded permanent total disability in benefits when he or she can no longer work due to a work-related injury. The workers’ compensation award is usually paid for the remainder of the worker’s life. Injured workers receive two-thirds of their average monthly wage as permanent disability payments. The payments continue for the lifetime of the injured worker. The payment to injured workers who receive permanent total disabilities is increased by 2.3% every year.
Vocational Rehabilitation Training
An eligible worker can learn an occupation that matches his or her physical limitations and educational status through vocational rehabilitation training. Benefits for job training may be available if the injured worker is physically restricted and cannot return to work, was not offered light-duty permanently and cannot work at 80% of their previous wages. It also applies if the worker cannot find a job that allows for their physical restrictions.
Vocational Rehabilitation Maintenance
While receiving training for a different occupation, a worker who receives vocational rehabilitation maintenance under workers’ compensation receives the same amount of benefits as a worker who receives temporary partial disability.
